Mary Hodges, is the Civil Processor Secretary. She is responsible for collecting and entering all court papers for the Sheriff's Office. These civil papers include civil & criminal witness subpoenas, divorce actions, child support, custody petitions, evictions, juvenile petitions and  jurors summons, just to name a few.

Certified Form Letter, NOT Stay-A-Way Notice(7-2010)

The purpose of the form letter is to get a message to the recipient that you do not want them to enter your property.  A citizen may send a form letter by certified mail to Franklin County or out of county respondents.  Contact your local US Post Office for the prices. 

Remember this letter will not:   Keep a spouse away from their home, prevent a person from contacting you in public places or keep you off someone else’s property. 

As always, if a violation occures, the complainant must come to the magistrate for a warrant.

 

Evictions

5 day notice is used when rent is deliquent.
30 day notice is used for breach of lease.
Notice to Tenant - a written notice with time and date will be given at least 72 hours before the eviction is to take place.
Notice to Landlord - coordinate the eviction with the Sheriff, if failure to comply, the Sheriff may cancel the eviction.
 

Liens, Levies & Sales and laws relating to each:

Lien - when a court renders a judgment for a plaintiff in a civil action.
Levy - placing legal claim upon specific property of the defendant, to satisfy the judgment.
Sale - levied property must be sold by public auction
Writ of Fieri Facias - judgment for money
Writ of Possession - judgment for specific property
Juror Summons - the clerk of court and the Circuit Court Judge will notify the Sheriff's Office of jurors. Only the Judge can excuse a juror. You may claim exemptions from Jury Service, but it needs to be directly from the court (judge).

The Criminal Warrant Secretary is responsible for entering and filing all criminal warrants, capiases issued by the courts, and any documents pertaining to the arrest of juveniles.
